1) Who we are

Spotlight (“Spotlight,” “we,” “us,” or “our”) is a platform that helps casting professionals and performers connect for projects. These Terms govern your access to and use of the Spotlight website, apps, and services (the “Service”).

2) Acceptance of Terms

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

3) Eligibility

  • You must be legally able to form a binding contract in your jurisdiction.
  • If you are under 18 (or the age of majority where you live), you may use the Service only with parent/guardian consent and supervision.
  • You represent that the information you provide is accurate and up to date.

4) Accounts & security

  • You are responsible for your account, including maintaining the confidentiality of your login credentials.
  • You agree to notify us promptly of any unauthorized use of your account.
  • We may suspend or disable accounts if we reasonably believe there is fraud, abuse, or security risk.

5) The Service is a platform (not an agency)

  • Spotlight is a marketplace/platform. We do not employ talent, act as a talent agent/manager, or guarantee bookings.
  • We do not vet, screen, background-check, or guarantee users, listings, roles, or communications (unless explicitly stated).
  • Any agreements, auditions, bookings, payments, or work arrangements are between users.

6) Listings, auditions, and safety

  • Users must provide honest, non-misleading listing and profile information.
  • Never share sensitive information (passwords, one-time codes, bank details, government IDs) in messages.
  • If you feel unsafe or suspect a scam, stop communicating and report it through the Service.

7) User content & permissions

“User Content” includes profiles, headshots, self-tapes, resumes, messages, listings, sides, and any other content you upload or submit. You retain ownership of your User Content.

  • You grant Spotlight a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely to operate, improve, and provide the Service (for example, displaying your profile to casting when you apply).
  • You are responsible for your User Content and represent that you have all rights necessary to upload it.
  • Do not upload content that violates privacy, intellectual property rights, or applicable laws.

8) Prohibited conduct

You agree not to:

  • Use the Service for harassment, threats, hate, sexual exploitation, or illegal activity.
  • Post scams, fake listings, deceptive offers, or impersonate others.
  • Attempt to collect sensitive personal data from users.
  • Scrape, crawl, or harvest data from the Service without permission.
  • Reverse engineer, disrupt, or compromise the Service or its security.

9) Payments, subscriptions, and fees

  • Some features may require a paid subscription (“Paid Features”).
  • Payments may be processed by third-party payment processors (e.g., Stripe). We do not store full payment card numbers.
  • Prices, billing intervals, and included features are shown at checkout and may change for future billing periods as permitted by law.

10) Cancellations & refunds

  • You can cancel subscriptions at any time. Access to Paid Features may continue until the end of the billing period.
  • Refunds (if any) are handled according to the policy presented at purchase and applicable law.

11) Intellectual property

  • The Service (including design, code, trademarks, and branding) is owned by Spotlight or its licensors and is protected by law.
  • You may not copy, modify, distribute, or create derivative works from the Service except as allowed by these Terms.

12) Reporting, moderation, and enforcement

  • We may remove content or suspend accounts that breach these Terms or pose risk to users.
  • We may investigate reports and take action at our discretion, including warnings, content removal, or account termination.

13) Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate your access if you violate these Terms or if we believe your use creates risk to the Service or others.

14) Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Spotlight disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

15) Limitation of liability

To the fullest extent permitted by law, Spotlight will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities. In jurisdictions where liability limits are permitted, Spotlight’s total liability for any claim related to the Service will not exceed the amount you paid to Spotlight (if any) in the 12 months before the event giving rise to the claim, or $100, whichever is greater.

16) Indemnification

You agree to defend, indemnify, and hold harmless Spotlight from and against claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.

17) Disputes

If you have a dispute with another user, you agree to try to resolve it directly with that user first. You acknowledge Spotlight is not responsible for disputes between users, contracts, payments, working conditions, or casting decisions.

18) Changes to these Terms

We may update these Terms. If changes are material, we’ll provide notice as required by law. Continued use after the effective date constitutes acceptance.
